La loi des hommes et la loi de dieu (FUN)

L’Eglise catholique possède un Droit propre : le Droit canonique. Il est composé d’un ensemble de normes qui est destiné à régir son organisation et la vie des fidèles (la composition des tribunaux, la question du mariage, les sacrements…). À la fois incarné et révélé, ce droit soulève de nombreuses questions. Quelles relations entretiennent la société civile et la société ecclésiale ? Comment la justice ecclésiastique est-elle organisée : tribunaux, peines et délits ? Comment ce droit participe t-il à la protection des libertés fondamentales des individus ? Autant de questions auxquelles nous tenterons de répondre dans ce MOOC.

Semaines 1 et 2 : L'Église catholique romaine est régie par le Droit canonique, méconnu voire inconnu du grand public, mais aussi d’un grand nombre de fidèles et par les non-baptisés. Ces deux premières semaines seront l'occasion de nous interroger sur ses fondements : origines, caractéristiques, liens avec le Concile Vatican II. Elles permettront d’introduire une distinction avec le droit séculier et les droits des autres confessions chrétiennes.

Semaines 3 et 4 : Posséder des droits dans l'Église ne vaut vraiment que si chaque fidèle a les moyens de les faire valoir. C'est pourquoi l'Église s'est dotée de structures judiciaires propres. Les tribunaux rendent ainsi la justice au niveau des diocèses, tandis que certaines causes sont réservées au Siège apostolique. Parmi les procédures les plus répandues, on compte celles en constat d'invalidité du mariage ou encore les causes pénales.

Semaines 5 et 6 : De nombreux droits séculiers proclament les droits de toute personne à la liberté de conscience et à la liberté de religion. Mais, d’un point de vue juridique : qu’est-ce que la conscience et quel rapport entretient-elle avec la liberté de religion ? Ces deux dernières semaines montreront que le Droit canonique peut être reçu comme un ensemble normatif servant une autorégulation interne au sein de l’Église. S’il appelle les fidèles au témoignage missionnaire, il prohibe le prosélytisme déloyal et abusif.

Format
Vous serez amené(e)s à suivre ce cours durant 6 semaines. Chaque semaine, nous vous proposons de visionner 30 minutes de vidéo (6 vidéos de 5 minutes chacune), de lire des documents courts et de vérifier vos connaissances à partir d’un quizz d’évaluation. Les cours sont présentés par Cédric BURGUN et Bruno GONÇALVES, Maîtres de conférences à la faculté de Droit canonique de l’Institut catholique de Paris, et Philippe GREINER, Professeur à la Faculté de Droit canonique de l’Institut catholique de Paris.

  5. L’organisation d’un tribunal ecclésiastique
  6. La carte judiciaire actuelle

SEMAINE 4 : Comment mettre en oeuvre une procédure canonique ?

  1. Les procédures canoniques
  2. Le cas particulier du mariage
  3. La réforme de la procédure en constat de nullité de mariage
  4. Pourquoi un droit pénal dans l’Église ?
  5. Les notions de délit et de péché
  6. Les différentes catégories de peines

SEMAINE 5 : Partir d’une approche en droit international :

  1. Approche de la notion de « conscience » en droit
  2. Distinction entre liberté de pensée, de conscience et de religion
