Storia del Diritto Romano (Federica Web Learning)

Il corso di storia del diritto romano, strutturato cronologicamente, si propone di offrire un efficace strumento per la comprensione delle nozioni fondamentali della storia giuridica, sociale, politica, costituzionale di Roma antica, dalle origini della civitas alla Codificazione giustinianea. L’analisi è tesa ad una corretta impostazione dell’approccio allo studio dei fenomeni antichi e del loro impatto anche sull’attualità, costituendo un viaggio lungo circa 1400 anni attraverso lo svolgersi dell’esperienza istituzionale e giuridica romana.

Il fuoco è su Roma antica, che si trasforma da piccolo villaggio a capitale di un grande impero mondiale, attraverso le forme costituzionali della monarchia, della repubblica, del principato e del dominato, fino all’esperienza, peculiarissima, dell’età Giustinianea con le sue compilazioni, si pensi al Corpus iuris civilis.
Nel corso delle lezioni si analizzeranno le strutture costituzionali, politiche e amministrative romane, si studieranno i principali provvedimenti normativi, le fonti del diritto (di produzione e di cognizione), si seguirà l’evolversi del pensiero e il tramandarsi del sapere giuridico attraverso i secoli, si vedrà come si amministrava la giustizia e come si svolgevano i processi criminali a Roma.
